Welcome to Blue Dot Creative. These Terms of Service (“Terms”) govern your use of our website, services, and any related communications provided by Blue Dot Creative (“Company,” “we,” “our,” or “us”).
By accessing our website, purchasing services, or otherwise engaging with Blue Dot Creative, you agree to these Terms.
Blue Dot Creative provides creative and digital services including but not limited to: Website Design and Redesign, Website Development, Digital Strategy Consulting, Branding and Visual Identity Design, User Experience (UX) and User Interface (UI) Design, Content Strategy, and Marketing and Creative Consulting.
Specific deliverables, timelines, and costs will be outlined in a written proposal, invoice, or service agreement between Blue Dot Creative and the client.
Clients agree to:
Provide accurate information required to complete projects
Supply requested content, assets, and approvals in a timely manner
Maintain communication during the project timeline
Ensure they have rights to all materials they provide
Delays in providing necessary materials may result in adjusted timelines.
All services require payment according to the terms outlined in the project proposal or invoice.
Typical payment structures may include:
Deposits prior to project initiation
Milestone payments during project progress
Final payment prior to launch or delivery
Unless otherwise stated:
Deposits are non-refundable
Late payments may result in project delays or service suspension
Blue Dot Creative reserves the right to pause work on overdue accounts
Clients are responsible for any third-party costs including but not limited to:
Domain registration
Hosting services
Premium plugins
Stock images
Third-party integrations
Each project includes a defined scope of work. Requests outside of that scope may require additional fees.
Unless otherwise specified:
Projects include a limited number of revisions
Additional revisions may incur additional charges
Client Ownership
Upon full payment, clients will receive full ownership rights to final deliverables created specifically for the project, unless otherwise stated.
Blue Dot Creative Rights
Blue Dot Creative retains the right to:
Display completed work in portfolios and marketing materials
Use project work for case studies or promotional purposes
Third-Party Assets
Some projects may include assets governed by third-party licenses (e.g., fonts, stock imagery, plugins). These assets remain subject to their respective licensing agreements.
Once project or retainer plan is concluded:
The client assumes responsibility for ongoing maintenance and security.
Blue Dot Creative is not responsible for issues caused by client modifications, plugin conflicts, hosting issues, or third-party services.
Either party may terminate a project agreement with written notice.
If termination occurs:
The client is responsible for payment for work completed up to the termination date
Deposits are non-refundable
Any completed deliverables may be released upon final payment
Blue Dot Creative will not be liable for:
Indirect or consequential damages
Loss of revenue, data, or profits
Issues caused by third-party services, platforms, or hosting providers
Our maximum liability shall not exceed the amount paid by the client for the specific service.
While Blue Dot Creative applies industry best practices in design and strategy, unless otherwise stated, we cannot guarantee:
Search engine rankings
Marketing performance
Conversion rates
Business outcomes
Results depend on numerous external factors outside our control.
Both parties agree to keep confidential information private, including:
Business strategies
Proprietary materials
Client data
Confidential information will not be disclosed without consent unless required by law.
Clients may not use Blue Dot Creative services for unlawful activities including but not limited to:
Fraud
Copyright infringement
Distribution of malicious software
Harassment, Discrimination or abusive content
Blue Dot Creative reserves the right to refuse or terminate services that violate these standards.
These Terms shall be governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
Any disputes arising under these Terms shall be resolved in the courts located within Texas.
Blue Dot Creative may update these Terms from time to time. Updates will be posted on our website with a revised effective date.
Continued use of our services after updates constitutes acceptance of the new Terms.
